The Netherlands to terminate its intra-EU BITs following the Achmea decision

In the wake of the decision of the Court of Justice of the European Union (CJEU) in Achmea v Slovakia, the Netherlands government has indicated that it will look to terminate its intra-EU BITs.  On 26 April 2018, the Minister of Foreign Affairs of the Netherlands informed the Dutch Parliament that the Netherlands would look to terminate its intra-EU BITs in an “orderly manner” and through negotiation of a new multilateral treaty.
